    Has anyone gone to Vancouver for H1B stamping? Please share your experience and any pointers. It will be a great help.

    Also, I found this on Vancouver consolate website:

    "Passports and visas will be returned to the applicants with Canadian addresses by Canada Post, generally within three to five business days after the visa is approved. In person pick up will be available only in a legitimate emergency (as determined by the Consulate). "

    This is disconcerting. I do not have luxary to wait 3-5 days to get my stamped passport via mail. Is this a standard process? Will they allow in-person pick up the same day?

    Hey,

    Lemme share my H1B Visa stamping in Vancouver, BC in July 2006:
    1. First of all, you need to fix a Visa Stamping appointment via www.nvars.com.
    2. Get a Canadian visa to make your trip to Canada. (I didn't have to do this since I hold Canadian Green Card.)
    3. On the appointment date, be atleast 1 hour ahead of your appointment time.
    4. Do not carry any electronic items (car remote, camera, etc) and food/liquid.
    5. Carry all the relevant paperwork along with cash in US dollars, just in case you wanna pay fees by cash.
    6. Present the documents asked for, and answer questions posed by the Visa officer confidently.
    7. The attending Visa officer will tell you to go to a particular counter to pay a reciprocity fee.
    7. Once the fee is paid, you need to collect your passport with new H1B visa stamped the next day at 3 PM.

    You will not be able to collect your passport with H1 Visa stamped the same day. If your paperwork is organized (meaning you have all the relevant documents for H1B visa stamping), you'll get your passport the next day. Normally, it is stated in their printed document that it would take 2 - 3 business days. In reality, you can collect it the next day unless your case requires more investigation (due to any missing documentation, etc) by the US consulate. You should stay there for atleast 2 business days to get your H1B visa stamping done. Getting your visa stamped in contiguous neighbouring country like Canada and Mexico is convenient as opposed to going to your home country which would otherwise cost your more time and money.

    --H1-B Case History--
    Had H1 with company X from June 04 to Dec 07. Applied for extension in Jun 07.
    Got RFE in Feb 08, received Denial on May 2nd, 08.had 2 options at that moment
    (1) Make an appeal ( which i did)
    (2) Leave the country in 30 days. ( which i obviously not choosen)

    Made appeal. same time applied for H1-B Transfer with Company Y with Premium Processing
    on May 29th,2008 through consular processing. Received Approval Notice on Jun 6th, 2008
    with Same I-94 number that of company X. I have to get visa stamped with
    company Y asap.

    --Points to be noted--
    (1) paystubb are still generated with company X till current date.
    (2) passport coming to expiration on March, 2009
    (3) I'm currently working at the client site.(started since Sep, 07)
    (4) Did Masters from Jan 2001 to Dec 2003

    --PIMS Verification--
    I heard new process being put in place.
    does any one knows the email id, phone number or fax to whom i should send the I-797 for Verification process. Planning to go Tijuana, Mexico.

    --Questions--
    Does any one can advice who have gone (or) is under similar situation
    on the following things?

    (1) Is it legal to work in current situation that I'm in
    (2) how good are my chances for getting visa stamped in Tijuana,Mexico.
    (3) Planning to go for stamping in Next couple of months. kindly let me know if any one
    wants to join me for getting stamping done in Tijuana, Mexico.
    (4) Additional information in this related is more than welcome

    There is no doubt that their work is a lot harder than it appears, but the point is that H1B is always interpreted as Visa for Computer Programmers ONLY, in the mainstream media. I think its time to publicize this new initiative from congress and let everyone know that H1B is not only for Programmers, it’s also for Fashion Models, Doctors, Engineers, Architects, Scientists and who knows what else! :mad:

    I think thats what kevinkris meant when he said "give me a break".

    That is true but I want one of them to be rejected and by not responding to FP and stopping payment on checks I am trying to exactly that.

    Rather than you taking a decision on this, let USCIS decide how to proceed with your case.

    I would like to find out if anybody here heard of H1B denial due to lack of MASTERS DEGREE IN PHYSICAL THERAPY.

    When I first read the notice of denial from USCIS I couldnt believe it. I satosfy all of the requirements stated on the letter to practice as a PT (specialty occupation) until I read a portion in OCCUPATIONAL OUTLOOK HANDBOOK (OOH) 2008-2009 (on the same notice) which stated that it requires a masters degree in PT as an entry level to practice PT.

    Ive been preacticing in the US as a licensed Physcial therapist for almost 5 years. I decided to have my H1B transfered to another employer and I got denied---for the above reasons. Im devastated. And now I have to stop working in 2 days---go back to my old employer and go home when my visa expires or I dont know...there is no paln B for now.

    Is it possible that they reject my application because my both PDs are not current ?
    ( EB3, 10-Nov-2004 as PD Which is not current and EB2, 10-Aug-2007 as PD which is not current either as per Aug and Sept months visa dates ) ?

    My Lawyer cited following in cover letter to prove that I am eligible for AOS.

    "The purpose of this correspondence is to inform you of the difficulties our office is facing when submitting an I-485 application on behalf of our client Mr.X. Mr.X is the beneficiary of two (2) approved I-140 petitions. Our cover letters to the USCIS have clearly evidenced Mr.X's eligibility to apply for Adjustment of Status pursuant of 8 C.F.R. Section 204.5(e) which states in relevant part:

    A petition approved on behalf of an alien under sections 203(b)(1), (2), or (3) of the act accords the alien the priority date of approved petition for any subsequently filed petition for any classification under sections 203(b)(1), (2), or (3) of the act for which the alien may qualify. In the event that the alien is the beneficiary of multiple petitions under sections 203(b)(1), (2), or (3) of the act, the alien shall be entitled to the earliest priority date.

    At-least I want verify that based on two PD's I am eligible to file for AOS.

    Hello All,

    I just got my EAD approved and I am waiting for my AP. I want to go back to school full time to pursue more education. If I do so, what will happen to my immigration status?

    Can I continue on my EAD? If yes, How?
    If I transfer to F-1, what will happen to my PD, EAD and AP?
    After completion of studies, can I utilize my PD or EAD?


    Please advice!

    I am also searching for directions to the university. But I don't think EAD would allow you to move to full-time student status. EAD is Employment Authorization Document and can be used only for employment, as far as I know. I will check with my lawyer too.

    I have received my Green card & My wifes green card during March. But I did not receive my daughter's (2 yrs old) green card even though it was approved
    by Immigration on Feb 24th. I received welcome letter also during March.

    When I called the USCIS helpdesk number, they said it was mailed to my address on Feb 28th and it might have been lost and I need to apply for I-90 to get replacement card.
    There is no tracking number also. They also said my daughter can use valid AP to enter to USA.

    Today I made an appointment through INFO PASS and talked to Immigration officer. He also said the same thing and also added that a Bio-metrics should be taken along with I-90 for my kid.

    My daughter is currently in India and planning to come back on July4th. She has a valid advance parole till Jan 2012. But the officer told that she can not enter to USA with Advance parole since her GC was approved. He asked me to contact local US embassy to get some travel document so that she can travel.

    I am confused now. Did anyone faced such situation ?

    According to my understanding, PIO is like a long term entry visa but it does not allow you to work. You would still need an employment visa.

    Only OCI visa holders can work without employment visa.

    You may want confirm the details on the Embassy website as they keep changing rules from time to time.

    First of Change the subject of this thread. This is confusing to state that your I485 is already denied.

    To your question:

    1. NO you cannot continue to work on EAD once your I-485 is denied. EAD is based on the pending I-485, once that is denied there is no basis for EAD to be valid. You are out of status immediately after the denial.

    2. Opening MTR takes months, if you are lucky then it might be quick.

    Now a question to you.

    1. Why do you think your I-485 will get denied? I assume you have all the documents supporting your legal status in US and on job. If so you should not be worried.

    The safe bet:

    That is the reason why people maintain dual status with H1/L1. That helps in these kind of situations.

    Just my thoughts, better consult with a lawyer if you are in such a situation.

    FedEx is the best, by far. UPS next. DHL is the worst (my personal experience).

    Always use FedEx, and if not possible, use UPS. Never DHL.

    FedEx is the best shipping company for both domestic and international.

    DHL is worse than UPS.

    It is in this order

    FedEX
    UPS
    DHL

    I have very very bad experiance with DHL.
