I-140 is specific to PERM labor to the location. If the employer do not apply I-140 within 180 of PERM labor approval that PERM labor will expire.

Is it true that H4 spouse, who do not have SSN are not eligible for tax rebate if while filing a joint tax return for 2007 ITIN is used for spouse.
It seems ITIN is given to illegal aliens too and hence it is not possible for IRS to determine which ITIN holders are legal and which are illegal. Thus they are not going to give tax rebates to ITIN holders.
My wife is on H4 and has a EAD/AP. Should I apply for SSN to receive the tax rebates? But since the tax rebates are based on 2007 tax return I will have to file the tax return using her SSN to get the rebates.
Also will SSN affect her H4 status if EAD is not used?
What do you guys think?

As far as I know, the 5 year wait period was until a couple years ago when the family based GC was backlogged. I got married in 2004 and had to wait until 2008 to file for GC, when my husband got his citizenship. At that time, our attorney advised this as the best course, since the priority dates were about 5 years out.
Filing for spouse falls under 2A of the family sponsored GC and currently the priority date for 2A India is 01 Jan 2010. In my estimation, you should get a GC within 12-18 mths.
But then again, I am not an attorney - so please consult one to validate this information.

My I-140 is applied during Jan 2007 under EB2 category. My LCA says Masters with 24 months experience amd alternative as Bachelors with 5 Yrs experience. As per the processing time updates, they are processing March 21st 2007. I don't see any updates other than Case is pending.
What should I do to get this processed?. Should I call customer service and ask for SR?

Yes. First I-140 should be cleared for you to port your PD to the second I-140.

My case was approved on Aug 19, 2010. I received my card on Aug 26, 2010.
Unfortunately, The EAD card had a wrong start date. I have sent my cards back for correction on Sept 2, 2010.
(I do have approval e-mail of my cards and the case.)
So, Question is, Can I work while my cards come back with the correct date. I don't have receipt of the replacement cards in my hand yet.
Please let me know.

You are not limited to change job within the same corporation. However you are limited to changing the job within same or similar occupation.
Old company can revoke I-140 since it is their application. They can not revoke I-485 since it is your application. You may get RFE to show that you are still employed in same/similar occupation but that's about it. You don't need to start all over or lose your place in the queue.

Most have their websites. Send email and they will get back to you.
If no websites, find the address from the State Governor's website and send a letter explaning the situation. they will send you a document-release form. Fill that form and send copies of all the required documents for your case.
Most Senator's office are really quick in correspondence.

I am trying to get a green card for the US. My parents are from east asia and I was born in Canada. I went to University in Maryland from 1992-96 and obtained my dental license. I am licensed in the US and intend to purchase a dental office soon. I will still be keeping my dental office in Canada for at least 1 year once I am able to work in the US. I heard about a investment visa however I am not investing more than $400k but it will employ at least 4 US nationals(ctizens). Can I still use the investment visa or can I get a visa for opening a secondary dental office in the US and still keep my existing office in Canada until I qualify for a green card. I had been out of status for about 1 yr n 2 months following my denial of I 140 n expiration of H1b, n currently residing in US. Now i have a new approval for H1b from USCIS, a month back. I was instructed by my employer to go back to my native country n get approval from from the consulate n re enter US. My lawyer instructed that i will be barred at the consulate or at the airport due to the history of over stay in US upon re-entering . Is there any one who have heard experinces of this kind ever? plz share your knowledge... thanks

i think majority of the Eb2 filings are under audit..
i ran my first ad..this sunday..and my lawyer didnt say a thing abt change in perm process.. but he did mention that Eb2 are being scrutinized more.

I haven't had "any" FP yet, but I have my EAD and my advanced parole for tavel. I also have my H1B current and stamped in my passport.
Last time I got H1B stamped in the embassy, they took my fingerprits, 10 fingers (I also asked if they want the 10 toes :D)
Can that fingerprinting in the embassy be the reason why they haven't sent any notices for my fingerprinting?
Should I be worried?
Can somebody, please, tell me how do you ask for a service request?

Me and my wife filed H1B extension through a company. I moved to consulting after my extension is approved. The consulting company filed my H1B transfer which is approved recently. Unfortunately my employer (the consulting company I moved to) dint file for my wife's H4 extension and he told that was not needed.
My question is can my wife with the petition approved from my previous employer to get her H4 stamped in India?
