Hello,
I have an "intend to deny" on my GC as EB1 that I got by applying myself as primary and wife as secondary. wife is on h1b and me on h4.we got EADs and if the GC is denied, we will lose the EAD.
I want to incorporate for several reasons hence i will be using the EAD for that.
using EAD invalidates H4 ? but H4 is automatic status based on H1b .
My wife did not apply for GC as primary and me on secondary but we intend to that in 3 years when it becomes current as EB3.

USCIS posted processing time as of Aug 31 2009.

They also updated information on their site about backlog.
USCIS: National Processing Volumes and Trends (http://dashboard.uscis.gov/) .
Backlog for I 485 pre adjudicated application went up by 20k. USCIS has mentioned few times that they will pre adjudicate all cases by Oct 2009. So we may see increase in those number till Oct 2009 posting. After that we will see reduction. How much reduction.. No one can guess. But definitely EB2 will not get more than 25k per year so it will be easily 5 years to clear all backlog for Eb2. Number may go up because of Eb3 - Eb2 porting after one year when they get their labor approved.

Hello ,
I recently changed my visa status from H4 to F1. I received my I-797 yestreday, and noticed that the I-94 attached with the I-797 has my birthdate printed wrong on it. I confirmed with my school, and they told me that there was a mistake in the I-539 application for change of status that I had filed, the birthdate was written wrong there. I also visited the local USCIS office and they told me they do not correct these errors and I need to send an application to the service center (california service center).
Please can anybody advice me as to what form do I have to fill, and how much time will this process take. I have got an oncampus job, in this case can I apply for a SSN with the I-797 with my birthdate mentioned wrong on I-94, my passport and my I-20 has the birthdate right. Also will there be any problem while my application to correct I94 is in process when I apply for my OPT since this is my Final semister in school
Please advice me I am really worried....

My H1b got Approved and starts from OCT 1st and OPT Extension Expires in July 1st week.
I am travelling to India for 2 weeks in next month.
Do I need to go for Stamping? or my Current student status is valid :confused:

I just came back from India with my H1 visa expired and my wife had a valid H4 visa until May. At the port of entry, Immigration officer told me that since she is on my dependent visa, she had to enter on AP also. so both of us used AP though she had a valid visa

Do u know if its possible to schedule an earlier fingerprinting date? can we just walk to a ASC with our appointment letter and get our fingerprinting done?
I filed for AOS at the beginning of May and had fingerprints done one month later. How quickly do you want them done?

NVC got my documents for 1 month
I am considering to email the NVC to check on the status of my case.
Should I email the NVC to check now (after waiting for 1 month) or wait another month (hence I would have waited 2 months) to check with the NVC on my status?

Pictures are listed in required list of documents but they don't ask for them always. My wife went for stamping 4 months back and they just looked at marriage-certificate and my approved petition....that's it ! But I have seen CO's asking for pics.
So it's a hit/miss kinda deal....

Any idea who represented skilled workers in the meeting that happened. I don't see Immigration Voice in the list.
Is IV core looking into how they can how they can be part of such meetings in future. If we are not represented, there wont be anything for us even in the comprehensive immigration reform. We employees cant rely on employers to represent us. That why we are where we are today.

Will it be ok to change employers multiple times on EAD with in shrt span of time difference?
yes, after being a 'chicken' for so long, I changed job on AC21 six months back. And since then changed twice after that. (once forced due to economy, second time moved to a better position) in fact now I am loving the freedom that comes with EAD. Only make sure you stick to same profession (programming) other things like salary or job title etc doesn't matter. Good Luck!

If your labor is not approved by June 09, you can extend H1-B based on pending labor for more than 1 year. If it will be approved before June, you will be able to apply I-140 premium processing and then extend H1.

I remember some time back having seen a link where you could get the list of labors/I-140 for a particular employer. I am not sure if it is in http://www.flcdatacenter.com/ . Can some one point to the correct link where you could get the list of H1 or Labor or I-140s approved for an employer based on the company name?
