Hello,
I was wondering how long it took for everyone's check to be cashed once their packages were received at the TX service center? I'm worried because from what I read before the check cashing was almost immediate, while getting a receipt actually took longer. My package was received and signed for by Michael Salcedo on November 13th, but the check still hasn't cashed and I do not have a receipt. My husband and I are planning on travelling to Canada for Christmas, will crossing the border be a problem? Any advice anyone can give would be great! Thanks in advance!

Hi,
My PD is Dec-04 and I-485 filing date is Sept-07.
I changed my job in Aug-2008 and discontinued my H1B which is expired in Sept-2008. Now my only legal status is 'adjustment of status from H1B to Permanent Resident'. I think this is very common state most of the people waiting looong for GC fall into.
Now, I saw one of my friend's i-485 denied (with NO option to reopen!) bcoz an approved I-140 was not attached to this application. I agree that this is not simple mistake for USCIS can ignore, but there is always a 'very very remote' possibility that every application can be quetioned due to some flows in the filing.
Here is my question: Since I discontinued my H1B status and I am still in this country, can I apply for a fresh H1B? I am thinking because H1B quota is still open this year and to face any unexpected reason for 485 denial!

Our son was out of the country when we filed our 485 on July 2nd. Now he returned to US, how shall we file his AOS? Form I-485 or anything else? Shall we include a copy of our filing inside?
In addition, the I140 was approved after we filed. And the principal applicant went out of the country and applied H1 visas and returned also.
Shall we include the updated information of the principal inside or just the copy of the original filing?

I am working on L1 from Company A.
I have applied for L1 to H1 status for year 2008 from comany B. H1 got approved without COS. As COS not done, I continued working on L1 with company A. Now my L1 is getting expired on Aug 2010 and my L1 company want to extend L1.

Tough talk from the Senate Majority Leader. Some, including my good friend Tamar Jacoby, think this is a really bad idea. I'm not so sure. I think fear of losing the Hispanic vote for a generation or more and the sudden urgency of the situation created by the Arizona fiasco could make responsible Republicans at least seek to block a filibuster and allow for a majority vote (as seems likely with financial regulatory reform). But Tamar is right that we'll get a better bill if pro-business Republicans play a role since some of the overreaching protectionist efforts of the unions...

We [Me(applicant) and my Wife(H4)] finally received our EAD's last week from NSC :> I have 2 questions:
1. Can i work part time.....apart from my 8 to 5 job based on my EAD. If yes, does the part time job need to be related or similar to my 8 to 5 job?
2. We had our FP done before we got our EAD's. Do we have to go back for additional FP after receiving EAD's? Anybody with similar situation?
Appreciate everyone's time.

You should change to H-4 (assuming you are eligible) if you are not working. You should be able to change back H-1B later and get the remainder of your 6 years, without being subject to the cap, if you find a new employer. It is important not to violate status now, and not working violates your H-1 status even if the lack of work is not your choice.

This is complicated. IF you are a citizen or if your wife has any US.S. citizen parents, she can file I-601 waiver application. But if your wife made unlawful entry , departed the U.S and reentered the U.S, then she is subjected to a permanent bar, and she cannot apply for a waiver for a period of 10 yrs. You need to consult a good attorney.

Here is my backgound -
1.Current status working on H1B 8th year extension for company A
2.Labor and I-140 is approved � EB3 PD 04/2006 - Company A
3.485 pending applied in August 2007 (> 180 days) - Company A
4.EAD & AP approved - Company A
5.Wife on H4 Status not filed for her 485 as she was not here.
I want do H1b transfer & work for another company B -(Job code & job duties are little different)
I don't want to use AC21 - just continue with Company B on H1 B transfer.
I am doing H1b transfer nothing else once dates are current will add my wife.
Am I doing something wrong or screwing up my GC process?
Please advise
