    Can someone employed on a H1B visa do small private/independent consulting on the side in the same field of work? Or can he/she get paid as a private consultant in his/her home country while on H1B visa in the US?

    Just couple of days ago immigration-law.com reported about IV and its efforts to bring relief to high skilled community and 2 days later the site gets hacked. I wonder if anti-immigrants have anything to do with it ...... they may be really scared to IV :D

    OR .. Matthew Oh really screwed up a programmer's green card process and he/she is really mad.

    hi gurus,

    please advise what are my options. I-140 is pending and i have 9th year H1-B expiring Dec 2009. still working for same company. in case I-140 stays pending up to December 2009. what should i do to stay in status.

    I filed my 485 application at TSC at the beginning of August, still did not get any receipt number, neither are the checks cashed.

    Any idea how long USCIS/TSC is taking these days to issue a receipt or cash the checks?

    Since AC21 does not go in any official USCIS form, it is better to attach with G-28. My attorney did that and USCIS had acknowledged their receipt of the G-28 and supporting documents. The Ack was a letter to me and the attorney when my (new) attorney opened a service request inquiring the attorney of record after 4 weeks of filing G-28 and AC21 documents.

    Good evening,

    I am currently in the United States and in the process of changing my Q1 into a F1 visa.

    My contract with the Q1 visa unexpedently ended in June 2009 and the visa was expiring on the 17th of september 2009.
    I sent the file with all the papers to the USCIS before the end of the expiration date and is still in process at this time.
    I heard that i can not exceed the period of 180 days after my last day of work with my Q1 Visa.. Is this true ?
    I was thinking by the time i filed everything before the end of my Q1 visa, i could stay in the United States until the approval or denial of my F1 visa...
    if this is true :
    1. Do I have to wait in France for the answer of the USCIS, or my case will be cancelled and I have to start all oveer again in France ?

    2. If I do not stay more than 180 days, going back to France and coming back for exemple 1 week after to the US with a tourist visa, am I able to change my status to F-1 ?

    3. If i receive an approval answer from USCIS after a few days that I've been back in France, will it be valid ? Can it be sent to me ?

    4. Do I have to get a new I-20 from the university if I am starting the process in France, or the one that I have is still valid ?

    Could you help me please, beause i am confused...:confused:

    Hello,

    I need your advice / opinion on the below scenario...

    I and my wife are both employed at the same company, currently on H1.
    I am the primary for our GC processing; my wife is dependent on me with regards to GC.
    We both got our EAD and AP. 140 approved in May 2007, 485 Filed in Aug 2007.

    I have submitted I-9 to the company in order to be on EAD status.

    I am planning to have my Wife resign from the current employer and work for a diff company/vendor by using EAD.

    Questions: 1.Does the above scenario bring up any issues with regards to our work status or any other issues with the current employer or to the GC process?

    2. Can I work on a part time project?

    Please advice

    I was in Canada and came back to US last weekend using AP. I only had two documents. They asked for three but I told them that I only have two and that is all I got from USCIS.
    They made me wait for 15 minutes and then stamped both AP documents and gave it back to me with an I 94 and entry date/stamp.

    I believe you should have your Advance Parole document and not with the immigration.

    We recently assisted a client from Johannesburg, South Africa, regarding an H-1B specialty occupation visa. He was approved for an H-1B visa, but in order for our client to enter the United States, he must obtain an H-1B visa in his passport. Because the chances of visa issuance vary greatly depending on documentation and individual circumstances, we suggested that he go to the interview at the U.S. consulate very well prepared. We told him to take a certified copy of his entire H-1B package that was filed with the Immigration Service, along with his Form I-797 Approval Notice. We also suggested that he take original birth certificates, marriage certificate, and proof of financial support. He attended the interview this morning and his experience at the U.S. consulate in Johannesburg, South Africa was documented as follows.

    “My wife, myself and our son had our interview at the U.S. Consulate here in Johannesburg this morning, at 9:00am. We duly arrived at 8:30am, had our relevant DS documents checked at the door, took a number, and waited for the “call.” At promptly 9:00am we were called to a booth, where our fingerprints were taken, the DS forms checked with the original I-797 form, and then told to go and sit down again. 10 minutes later, we went back to the booth, had our fingerprints taken again, and that was it. All visas approved, and to pay DHL the delivery costs. No questions asked, no documents asked for, no requirement of proof of copies of documents, nothing. All in all a painless and easy task.”

    See the comments below, keep in mind it's my personnel opinion...

    Hi all,

    I am in the middle of H1-B transfer from Comp A to Comp B.. I have an urgent question,
    Company A didn't run my payroll from 11/26/07-4/11/08 because i was out of the project,since then i have had a consistent payroll no gaps, my question is

    1.will that affect my H1-b transfer?

    I dont think it will affect as per my knowledge, in verst case, they might ask for your 2008 W2 from the old company and I assume that you had on payroll from May to year end, so you can show that if they ask

    2.will USCIS go back that far to verify my paystubs?, and

    Normall they will go back to 6 months max, but be prepare to submit the Client letter to prove that you have project for next couple of years, keep in mind that if you show client letter for only few months, USCIS is will issue only for that period, it happened for couple of guys....these days proof of project is a key for transfers...good luck....
